Ever since the internet burst into public consciousness in 1993, the big question has been whether the most disruptive communications technology since print would be captured by the established power structures ? nation states and giant corporations ? that dominate our world and shape its development. And since then, virtually every newsworthy event in the evolution of the network has really just been another skirmish in the ongoing war to control the internet.

We now know more about what led to the impasse at the WCIT, and the scope of the fissure that it created. It is clear that nations will split 2 to 1 in favor of signing the ITR treaty. The majority of the signatories are the developing countries in Africa, Asia (including China), the Middle East, Latin America, and of course Russia. The refuseniks are primarily developed, western economies; they are concentrated in North America, Europe and Japan, although they were joined by India and some other developing countries. Though smaller in number, refuseniks account for probably two-thirds of the telecommunications and Internet economy. Politically, this is a troublesome bifurcation, although its implications for internet governance may not be all that bad.

The problem with setting expectations is that when they are not fulfilled the fallout is generally considered to be a failure, and while everyone wants to claim parenthood of success, failure is an orphan. In that sense it looks like the WCIT meeting, and the International Telecommunications Regulations (ITRs) that were being revised at that conference this month are both looking a lot like orphans. There have been a number of reports of the outcome of the two week... Most of the blogs were quick to characterize the outcome as a loss for the dark forces that lurked somewhere in the closets of the ITU's headquarters in Geneva. But there is more to it than that.

This is a question about the differences in ISP retail models for broadband Internet access and the choice between a retail model of a "unlimited" flat fee that has no volume component, and a "capped" model where the service fee provides for a certain data volume and when that volume is reached either the user is exposed to an incremental fee, or the service is throttled back to a narrowband service for the remainder of the billing period.
