Abstract: Trademark owners have pursued cybersquatters for, in the early years of the Internet, claims of trademark infringement and dilution and, later, for claims under the Anticybersquatting Consumer Protection Act. However, a recent trio of cases has opened the door to a potential cause of action against domain name registrars based on contributory liability for cybersquatting. The decisions in these cases are broadly consistent with a recent trend that has seen trademark owners suing online markets and service providers for the wrongdoing of their clients.

Abstract: Since the Beijing First Intermediate People?s Court received the first cybersquatting case in China, Fulande v. Mitian Jiaye, in April 1999, Chinese courts had received more than 40 cybersquatting cases by July 2001. Internationally well-known trademarks, such as ?Tide,? ?Ikea,? and ?Safeguard,? have been involved in cybersquatting claims. Although Chinese courts promptly reacted to this newly emerging question, absence of pertinent legal rules resulted in uncertainty and inconsistency in decisions from different courts. The Trademark Law and Anti-Unfair Competition Law of China, were quoted by most courts as legal basis, however they failed to provide sufficient remedies against cybersquatting.

A message from ICANN's Communications Department: On 20 June, 2011, ICANN's Board of Directors approved a plan to dramatically increase the number of generic top-level domains (new gTLDs). The Board had previously specified that if the plan were approved, there must be a "minimum of four months" spent in raising global awareness of the new opportunity, before applications for new gTLDs could be accepted. Aware that some global communities are difficult to reach in August (for example, many Europeans vacation then, and Ramadan also occurs then), when the Board approved the New gTLD plan on 20 June, the Board also extended the communications period to roughly six months.
