The overarching purpose of its thesis aims to identify an inherent compatibility between Canadian trademark law and the Internet, while also clearly delineating the Canadian legal framework vis-a-vis domain names. In shedding light on this legal symbiosis, the article ventures upon a comparative study of Canadian, US, and UK jurisprudence, while also taking stock of certain arbitral structures such as ICANN, in order to highlight horizontal legal transplants that will have direct incidence on Canadian online business. Among the themes canvassed, particular emphasis is placed on the ever-increasing extraterritoriality of US law in this field, along with the acknowledgement that US judicial precedents wield considerable influence over Canadian intellectual property policy. As a corollary to this proposition, deference to transboundary domain name litigation and transnational law-derived considerations also pervade the discussion. The merging of Canadian trademark law and Internet domain name regulation is ultimately actuated through the extension of foundational trademark concepts, such as confusion and passing off, to the Internet, along with judicial pronouncements emanating from cognate common law jurisdictions, which are conflated into a single, overriding approach. http://papers.ssrn.com/sol3/papers.cfm?abstract_id=884321 *********** GOVERNANCE *********** Internet Governance Forum Advisory Group to be Established In light of the consultations on the convening of the IGF, the United Nations Secretary-General will set up a multi-stakeholder Advisory Group to assist him in this task. The 11-page measure would require the U.S. Department of Commerce to work with ICANN to develop plans for a domain name system that would house material deemed "harmful to minors." http://news.com.com/2100-1028_3-6050973.html http://news.zdnet.com/2100-9588_22-6050973.html http://freespeechcoalition.com/quentinxxx.htm http://smh.com.au/news/breaking/put-all-porn-in-xxx-domain-us-senators/2006/03/17/1142098637437.html http://www.arkansasnews.com/archive/2006/03/17/WashingtonDCBureau/334933.html http://www.optusnet.com.au/news/story/abc/20060318/12/tech/1594225.inp http://americasnetwork.com/americasnetwork/article/articleDetail.jsp?id=313255 http://politics.slashdot.org/article.pl?sid=06/03/18/0315255 http://arkansasnews.com/archive/2006/03/17/WashingtonDCBureau/334933.html http://www.helenair.com/articles/2006/03/17/montana/a07031706_01.txt http://www.mtstandard.com/articles/2006/03/18/newsstate/hjjdjgicjjgcih.txt http://www.nbc10.com/technology/8078922/detail.html http://www.ktvu.com/technology/8078922/detail.html http://www.foxnews.com/story/0,2933,188163,00.html http://billingsgazette.net/articles/2006/03/16/news/state/15-porn-domain.txt http://www.kark.com/news/default.asp?mode=shownews&id=6004 http://www.montanastandard.com/articles/2006/03/18/newsstate/hjjdjgicjjgcih.txt http://www.allheadlinenews.com/articles/7002826866 au: Government orders spoof site shut A spoof John Howard website that featured a soul searching "apology" speech for the Iraq war has been shut down under orders from the Australian Government. http://smh.com.au/articles/2006/03/17/1142098638843.html http://p2pnet.net/story/8235 http://smh.com.au/news/breaking/howard-spoof-site-vanishes/2006/03/16/1142098589270.html au: Censorship in cyberspace?
