Protection of Celebrities Names and Trade Marks under the
ICANN Uniform Domain Name Dispute Resolution Policy
The object of this article is to look at the main
characteristics of the domain name disputes under the UDRP
that involved celebrities and see what kind of problems may
be faced by famous persons who wish to get back their
names. For the sake of clarity our discussion will be
limited to the cases resolved by the WIPO Arbitration
Center. We will also not analyse any national remedies that
may be available to celebrities like the Anticybersquatting
Consumer Protection Act of the United States.

Microsoft had no right to take domain name
Mike Rowe only wanted to create his own Web site. But this
past November, the Microsoft Corporation sent an e-mail to
the Canadian high school student and ordered him to close
his site, MikeRoweSoft.com, which the company considers to
violate Microsoft trademark rights. In an attempt to convey
the company's "generosity," Microsoft offered the young man
$10 to sign the domain name over to them, which would be
enough to cover the initial setup fee for the domain name.

uk: Roxio wins napster.co.uk from the Crown
Roxio, the company behind the newly-legitimised Napster
music service, has won a battle for napster.co.uk. The UK's
domain name registry ruled that a registration of the name
by the Treasury Solicitor was "abusive" and ordered that it
be transferred to Roxio.

Updated Inter-Registrar Transfers Policy Information
The new transfer policy is intended to provide a procedure
for the smooth transition of a domain name from one
registrar to another when such a change is requested by the
domain name holder. The Transfer Task Force Group has
developed 29 policy recommendations for guiding such
transfers. A Transfer Assistance Group (TAG) was formed
with assistance from the Registry Constituency, the
Registrar Constituency, the ALAC, and the Transfer Task
Force.

Privacy Alert: Watch Out For FOISA
This morning, at 10 am in 2141 Rayburn, the Subcommittee on
Courts, the Internet, and Intellectual Property is holding
a hearing on "Internet Domain Name Fraud -- New Criminal
and Civil Enforcement Tools." At that hearing, the
Subcommittee will be considering a new Whois bill creating
new penalties for people who provide false data when
registering a domain name. We need to raise our collective
eyebrows at this bill (which was suddenly dropped the
evening before this hearing). The title of the bill is the
"Fraudulent Online Identity Sanctions Act" (FOISA).

Report on TLD Preference by Country
Which domain extensions do people prefer? How do these
preferences vary by country? This article reports the
results of a poll of domain extension preference by country
of residence conducted from May through October, 2003 by
Domain Name Journal and the DomainState forum.
Approximately 133 people from 34 different countries
participated. This poll has limitations that we will
discuss, but it does measure the extension preferences of
domain registrants and developers in a manner that has not
been done elsewhere and it produces some interesting
results.
