The Court decided that, although a pseudonym also acquires protection under the name right, such protection is only enforceable where the user is known under that name. http://www.bmck.com/elaw/archivehome.asp Cybersquatting and Misspelled Domain Names - from Baker & McKenzie Global E-Law Alert The Complaint Board for Domain Names recently decided two cases in which a business had registered misspelled domain names of two well-known company web sites, i.e. "wwwnykredit.dk", "www-nykredit.dk" and "nukkredit.dk" rather than "nykredit.dk". Nykredit is a major Danish financial institution. The registrations in question were only a few out of more than 400 registrations. The Complaint Board found that the registrations not only constituted an infringement of the well-known trademarks, but were also a breach of good marketing practices. The board found that the registrations should be transferred to the complainants. http://www.bmck.com/elaw/archivehome.asp Holocaust Copy Web Site - from Baker & McKenzie Global E-Law Alert The Complaint Board for Domain Names has decided a case regarding the two web sites "holocaust-uddannelse.dk" and "holocaustuddannelse.dk". "Holocaust-uddannelse" translates to "Holocaust-education". The former web site was launched in 2001 by a publicly funded but independent institution studying historic and current events relating to genocide. The latter web site was launched in 2002 by an organization denying the occurrence of the Holocaust. The Complaint Board found that both the domain name and the content of the latter web site were clearly copying the original web site and thus ordered "holocaustuddannelse.dk" transferred to the complainant. The board found that the actions were in breach of honest conduct, citing the principles on good marketing practices. http://www.bmck.com/elaw/archivehome.asp Government Wins Domain Names - from Baker & McKenzie Global E-Law Alert A CIRA adjudication panel ordered the transfer of several .ca domains to the Government of Canada on the grounds they were confusingly similar to the government’s trademarks and the registrant had no good-faith interest in them http://www.bmck.com/elaw/archivehome.asp Juniper's IPv6 Advocate Tests Mythology IPv6 advocacy has been tainted by FUD and half-truth. CommsWorld recently interviewed Juniper's Jeff Doyle, who is a strong supporter of IPv6 -- but who also has little patience for IPv6 mythology. Forget security, half-true address crises and QoS: the best reason for the world to run with IPv6 is what's driven the Internet all along -- innovation. http://www.circleid.com/article/158_0_1_0_C Analyzing The Inbox of a Spammer’s Domain Consider this scenario: you need a domain name for your site so you go to your favorite domain registrar’s website and upon a quick search find that your third choice is actually available! You quickly pull your credit card and register the name. Everything is good and you can’t wait to have your new domain start pointing to your site and represent your official email address. But not so fast -- some of the recent events are revealing that, these days, when you are registering a domain name there is one more critical thing you need to do: check under the hood! http://www.circleid.com/article/156_0_1_0_C/ Fight Spam With the DNS, Not the CIA It seems like spam is in the news every day lately, and frankly, some of the proposed solutions seem either completely hare-brained or worse than the problem itself. I'd like to reiterate a relatively modest proposal I first made over a year ago: Require legitimate DNS MX records for all outbound email servers. http://www.circleid.com/article/151_0_1_0_C/ UDRP Dilemma In Proving Bad-Faith Domain Registrations - Part III In the final part of this 3-part series article, the issue of UDRP in proving bad-faith domain registrations that are held passively is examined with respect to the trademark’s characteristics. http://www.circleid.com/article/152_0_1_0_C/ +++++++++++++++++++++++++++++++ Check out http://www.auda.org.au/about/news for the latest domain news.
