ICANN Posts Report for First Quarter of 2003
In the first quarter of 2003, the Internet Corporation for
Assigned Names and Numbers (ICANN) made significant
progress in several key substantive areas, while continuing
towards completion of its reformed structure begun a year
ago. The details are described in the ICANN Quarterly
Report to the U.S. Department of Commerce (DOC), just
posted, for the first quarter of 2003.

Interactive Products Corporation, Plaintiff-Appellant, v.
a2z Mobile Office Solutions, Inc., Brian Lee, Mobile Office
Enterprise, and Douglas Mayer, Defendants-Appellees.
This case presents a novel trademark issue with regard to
the Internet along with several other more straightforward
issues. Interactive Products Corporation ("IPC") brought
this action alleging, among other things, federal and state
claims of trademark infringement, false designation of
origin, false advertising and trademark dilution. IPC's
claims arise primarily out of the fact that defendant a2z
Mobile Office Solutions, Inc. ("a2z") maintains an Internet
web page that contains IPC's trademark in its URL.(1) IPC
also complains about a particular message that appeared for
about a year on a2z's web page regarding IPC's trademarked
product.

Rules of Procedure for the GNSO Council
At the GNSO teleconference it was resolved that the Generic
names Council would operate under the Rules of Procedure
for the old DNSO Names Council except in cases of conflict
with the new ICANN bylaws where the ICANN new bylaws take
precedence.

WIPO Decision in Urbani.com
The Decision of the Administrative Panel is that the
disputed domain name <urbani.com> is identical to the
trademark URBANI in which Complainant has rights.
Complainant has not proven that Respondent has no rights or
legitimate interests in the disputed domain name and has
not proven that Respondent registered the disputed domain
name in bad faith. Complainant’s application for transfer
of the domain name is denied.
