For various reasons (including the practice of many resellers, ISPs etc who put their own contact details in AUNIC instead of the registrant's), sending an email to the AUNIC database would not have the effect of reaching all com.au registrants. Instead, auDA requests Melbourne IT to send consumer alerts to its own database of com.au registrants, which is far more up-to-date and reliable than AUNIC at reaching the actual registrant and not their reseller, ISP etc. auDA is not a government authority. Unlike the ACCC, we do not have any legislative standing or powers to act against offenders. We are a self-regulatory body. At the moment, auDA does not have any direct control over the industry. Resellers (in com.au) are licensed by Melbourne IT, not by auDA. Under the new regime, all registrars will have to sign an agreement with auDA that governs their behaviour, and makes them responsible for the actions of their resellers. auDA will be able to suspend or terminate the agreement if the registrar (or their reseller) is in breach. Until these new agreements are in place, auDA's efforts to protect consumers are focused on educating the marketplace, and encouraging the industry to abide by the Interim Code of Practice that we issued last year (and that a committee of industry and consumer representatives are currently revising). Posting alerts on your website is great but as we are all aware, very few Australian consumers wake up with thoughts of checking the auDA website for consumer alerts. If you had the means, why were consumers not well informed? The ING suspension is one thing, but IRA etc etc .. are still out there circulating deceptive marketing material.
