Reprehensible as the practice is, and as repulsive as they are, fax-spams do not make subdomains names illegitimate or a scam either. The namespace is owned by an individual (the owner of the .au.com domain); but that does not make xxx.au.com illegitimate. As to whether *I* would register an xxx.au.com domain name - well, I wouldn't. But that doesn't make the subdomains illegitimate or a scam.
